Kill the Bill: Evaluation-Based Charitable Donation – Official Promotion Terms

These Official Promotion Terms (“Terms”) govern participation in the Kill the Bill (the “Promotion”) offered by Dash0 Inc. (“Dash0”). By participating in the Promotion, the participating company (“Participant”) agrees to these Terms.
1. Promotion Overview
The Promotion is a marketing program under which Dash0 will make charitable donations in amounts determined by Dash0’s analysis of whether a Participant would achieve cost savings by switching its observability platform spend to Dash0’s services.
For clarity, no Participant or its representatives receive anything of monetary value, and no purchase, payment, or commitment to purchase is required to participate. This Promotion is a marketing promotion only and is not a contest, sweepstakes, lottery, or game of chance.
2. Eligibility
To qualify, a Participant must:
- Be a company or other legal organization with between 150 and 10,000 employees;
- Currently spend at least USD $50,000 per year on observability tools with Datadog, Dynatrace, or New Relic;
- Be legally established and operating in the United States or one of the Eligible European Countries listed in Section 13; and
- Designate a representative who is authorized to (a) provide information during the evaluation call and (b) accept these Terms on the Participant’s behalf.
The Promotion is void where prohibited by law. Dash0 may request reasonable evidence demonstrating that a Participant meets the eligibility requirements and may disqualify any Participant that fails to provide such evidence. Datadog, Dynatrace, and New Relic are trademarks of their respective owners. Dash0 is not affiliated with or endorsed by any of these companies.
3. How to Participate
To participate, an eligible Participant must:
- Register using Dash0’s designated sign-up form;
- Schedule and complete a live evaluation call with Dash0 by December 31st 2025; and
- Provide information reasonably necessary for Dash0 to evaluate the Participant’s current observability spend and compare projected costs under Dash0’s services.
Dash0 may decline to conduct or complete an evaluation if the Participant does not provide sufficient information or otherwise does not meet these Terms.
Participation is not conditioned on consenting to publicity, and opting out of publicity will not affect a Participant’s eligibility, evaluation, or the donation amount attributable to that Participant.
4. Determination of Donation Amount
After the evaluation call, Dash0 will determine whether the Participant’s projected cost savings from switching to Dash0’s services would be:
- 50% or greater (“High Savings”); or
- Less than 50% (“Low Savings”).
The savings determination will be based on Dash0’s standardized internal pricing and cost-comparison methodology in effect at the time of the evaluation, using the information provided by the Participant and other reasonable assumptions. Dash0’s determination is final, nonappealable, and not subject to negotiation.
5. Donation Amounts
Following the evaluation:
- For Participants determined to have High Savings, Dash0 will donate USD $500 to a charity as described in Section 7.
- For Participants determined to have Low Savings, Dash0 will donate USD $10,000 to a charity as described in Section 7.
No Participant or its representatives receive any donation, rebate, credit, or other financial or in-kind benefit from the Promotion. Participants and their employees are not eligible to claim any tax deduction in connection with these donations.
Dash0 will make the applicable donation within [60] days after making its evaluation determination. Dash0 may, at its discretion, make a single aggregated charitable donation in an amount equal to the total donations earned under these Terms, rather than separate donations per Participant. Whether the donation is made individually or in aggregate, the donation amount attributable to each Participant will be determined in accordance with Section 4.
Dash0’s total aggregate donation under this Promotion will not exceed USD $35,000 (the “Donation Cap”). Once the Donation Cap is reached, no further donations will be made under this Promotion, even if additional Participants complete evaluations that would otherwise qualify for a donation under these Terms.
6. Publicity; Optional Participant Acknowledgment
Subject to the consent mechanism described below, Dash0 may publicly acknowledge Participants in connection with the aggregate charitable donation described in Section 5, including listing a Participant’s company name in promotional materials, on Dash0’s website, or in Dash0’s announcement of the donation.
Dash0 will use a Participant’s name for publicity purposes only if the Participant affirmatively consents (opt-in) during the registration process. Participating companies that do not opt in will still be included in the Promotion and donation calculation but will not be identified publicly.
A Participant may revoke its consent at any time by contacting Dash0 at marketing@dash0.com. Revocation will apply prospectively and will not require Dash0 to remove or amend public disclosures already made before Dash0 reasonably could act on the revocation.
Dash0 will not use any individual employee’s personal name, likeness, or other personally identifying information for publicity purposes.
7. Charity Selection
Dash0 will make each donation to a charitable organization whose primary mission is to improve the lives, health, safety, and education of children worldwide, or to another charity with a substantially comparable mission if the initially identified organization becomes unavailable or declines participation.
8. Promotion Period
The Promotion begins on December 2, 2025 and ends on December 31, 2025, at 11:59 p.m. Pacific Time (the “Promotion Period”), unless extended, suspended, or terminated earlier by Dash0 in accordance with Section 11.
All evaluation calls must be completed by December 27, 2025 to qualify.
9. Representations
Participant represents and warrants that all information it or its representatives provide to Dash0 (i) is accurate to the best of Participant’s knowledge and (ii) may be provided to Dash0 without violating any law or any contractual, confidentiality, privacy, or other third-party rights.
Participant acknowledges that inaccurate, incomplete, or misleading information may disqualify it from participation or alter the evaluation outcome.
10. No Purchase Necessary; No Obligation
Participation in the Promotion:
- Does not require purchasing Dash0’s services;
- Does not obligate Participant to switch providers now or in the future; and
- Does not guarantee that Participant will achieve any particular future savings.
11. Dash0 Rights; Modifications
Dash0 reserves the right, in its reasonable discretion, to:
- Verify eligibility;
- Disqualify any Participant that violates these Terms or provides false, misleading, or incomplete information;
- Modify, suspend, or terminate the Promotion, or any portion of it, if fraud, technical issues, legal or regulatory requirements, changes in business conditions, or other circumstances make continuation impracticable or unlawful; and
- Limit the number of evaluations or end the Promotion once the Donation Cap described in Section 5 has been reached, including by declining additional registrations or clearly disclosing on the Promotion page that no further donations will be made under this Promotion.
Any material changes to these Terms will be posted at [dash0.com/policies/kill-the-bill-terms] and will apply on a go-forward basis.
12. Privacy
Information collected in connection with the Promotion will be handled in accordance with Dash0’s Privacy Policy, available at [dash0.com/policies/privacy]. Participants should review the Privacy Policy for information about how Dash0 collects, uses, and discloses personal data and any rights they may have.
For Participants in the EU/EEA, Dash0 will comply with applicable data-protection laws, including providing required disclosures at the time of data collection and obtaining any consents required for processing or publicity.
Dash0 will not publicly disclose any Participant’s name for publicity purposes unless the Participant has affirmatively opted in pursuant to Section 6. For EU/EEA Participants, such disclosure will occur only with explicit consent that meets applicable data-protection requirements.
13. Eligible Jurisdictions
This Promotion is open only to Participants that are legally established and operating in:
- The United States (excluding any jurisdiction where the Promotion is prohibited or would trigger registration, bonding, or other requirements that Dash0 elects not to satisfy); and Canada, Germany, United Kingdom, Finland, Italy, Czech Republic, Belgium, Lithuania, Ireland, Switzerland, France, Denmark, Netherlands, Norway, Poland, Romania, Sweden, Liechtenstein, Estonia, Spain, Portugal, Malta, Austria, North Macedonia, Hungary, Slovenia, Ukraine, Gibraltar, Isle of Man, Luxembourg, Latvia, Greece, Bulgaria, Slovakia, Serbia, Croatia.
Dash0 may update this list from time to time as necessary to comply with international marketing, charitable-solicitation, and promotion laws. Any such updates will be posted at [dash0.com/policies/kill-the-bill-terms] and will apply prospectively.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Dash0 and its affiliates, officers, directors, employees, and agents are not liable for:
- Incomplete, inaccurate, or misleading information supplied by Participants;
- Technical or communication issues affecting registration, scheduling, or participation; or
- Any difference between projected savings discussed during the evaluation and actual future pricing or savings.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.
15. Governing Law; Venue
These Terms and any disputes arising out of or relating to the Promotion will be governed by the laws of the State of California, excluding its conflict-of-laws rules. Subject to any mandatory laws that apply, the exclusive jurisdiction and venue for any such dispute will be the state and federal courts located in San Francisco, California, and the parties consent to personal jurisdiction in those courts.
